Buying apartments and condominiums in Istanbul
A luxury flat is not just its interior and view: the buyer takes on a registered interest in a specific unit and a financial relationship with a shared building. In Istanbul, the best-looking offer may be unsuitable if the title does not match the advertised area, a costly structural project is pending, the monthly aidat is high, or the desired letting use cannot be licensed. Compare location and daily usability first, but do not commit a non-refundable sum until the legal and building evidence agrees with the sales story.

Start with intended use, not a district ranking
Decide whether the flat is a primary home, an occasional residence, a long-term rental or a short-stay investment. Write down the maximum all-in price, realistic monthly charges, commute and airport routes, desired floor, accessibility, parking needs, occupancy date and exit horizon. Test an ordinary weekday journey, not only an agent’s weekend viewing. A Bosphorus outlook does not solve steep access roads, noisy traffic, restricted parking or unreliable building services. For a holiday home, secure management and a practicable lock-up arrangement may matter more than proximity to an office district. For a rental purchase, check actual permitted use, tenant demand and net costs; photographs or an unverified yield projection are not evidence. Split criteria into non-negotiable requirements, price-adjustable inconveniences and issues that end the search.
Compare the building formats on equivalent terms
An established apartment can reveal actual utility bills, occupants and building accounts, but may have older equipment, structural exposure or expensive retrofits. A new development may offer lifts, energy systems, parking and amenities, yet requires independent verification of completion status, approved plans and what has actually been delivered. A serviced residence can remove day-to-day chores, but management charges and operator rules may constrain letting and resale. A small-owner block might have lower published charges but weak reserves and ad hoc maintenance. Evaluate usable interior area, legal unit boundaries, included storage and parking, energy and noise performance, building age and engineering evidence, not brochure labels such as ‘residence’ or ‘condominium’. The following trade-offs describe questions to test, not verified live stock or neighbourhood prices.
To compare two offers, use the same dated worksheet: registered unit and verified usable area (not an unexplained gross-area figure), asking price per usable square metre, annual aidat, approved extraordinary contributions, likely in-unit repairs, and actual door-to-door travel time. Mark missing evidence “unverified”, never zero cost. This method screens individual offers; it is not an Istanbul price index.

| Building format | Possible advantage | Evidence-based caution |
|---|---|---|
| Existing apartment | Verified accounts, actual occupancy and observed defects | Age, repairs, reserve shortfall and seismic records |
| New/off-plan unit | Modern specification and potential integrated amenities | Completion, permits, delivery and developer/land rights |
| Serviced residence | Operator services, security and convenience | Service charges, operator rules and licence boundaries |
| Small co-owned building | Direct decisions and potentially modest visible fees | Unfunded works, disagreements and uncertain accounting |
Identify the right being sold and the usable area
Ask for a current tapu record and independent-unit number, parcel details, approved floor plan and the building’s yönetim planı. The Turkish system distinguishes registered condominium ownership (kat mülkiyeti) from a construction-stage floor easement (kat irtifakı); neither term alone proves all completion, permitted-use or building-compliance issues have been resolved. Check the occupancy or building-use document (yapı kullanma izin belgesi / iskân) where applicable, and independently reconcile the registered unit with the physical floor and door. A terrace, parking bay, storage room, garden or rooftop deck may be private, allocated for exclusive use, shared, or merely advertised. Demand the exact legal instrument and plan before assigning value to it. Verify mortgage, attachment, easement, restriction and outstanding registration issues before signature.
Inspect the association finances and decisions
Request the management plan, recent general meeting minutes, current budget, annual accounts, collection and arrears position, service agreements, insurance evidence, planned repairs and any lawsuits or major disputes. Ask who pays routine aidat, how it is allocated, whether any extraordinary contributions are approved or proposed, and whether the seller owes outstanding charges. The quoted monthly fee is meaningful only if you know what it includes: heating, water, security, pool, gym, lift care, reserve funding and operator services may be bundled differently. A building with a low fee and no funded repairs can cost more than a well-managed property with a higher transparent fee. Get dated written figures from management; a broker’s verbal estimate is insufficient. Have a Turkish adviser check which charges or liabilities pass on with the unit.
Treat seismic safety as a building-level question
Istanbul’s seismic exposure makes construction documents and competent engineering review central to selection. Obtain the building year, permits, structural drawings where available, material or assessment reports, repair history and any official notices about unsafe buildings or urban renewal. Look for altered ground-floor columns, illegal extra storeys, water ingress and major façade or foundation work; a cosmetic renovation proves none of these safe. Istanbul Metropolitan Municipality (İBB) offers rapid-building screening for some building categories; it is not a definitive structural assessment. Request an independent structural engineer’s evaluation proportionate to the building and records. No postcode, completion date, premium developer brand or exterior photo can certify an individual unit’s earthquake resistance.
Check residence, alteration and rental rules separately
An apartment being advertised as ‘investment-ready’ does not establish its legal permission for short stays. Turkish Law No. 7464 generally requires a tourism-purpose letting permit for contracts of 100 days or less; ordinary multi-owner buildings generally require a unanimous owners’ decision for the permit, subject to the law’s distinct rules for qualifying high-quality residences and other special cases. The owner must establish the applicable building category and licence position before relying on short-term revenue. Long-term tenancy, change of use, façade or balcony alteration, pets, business activity and access to amenities may be constrained by the management plan, applicable law and contracts. Do not assume a rental licence, right to sublet or relocation/residence entitlement follows from buying a flat.
Foreign purchasers: verify eligibility before paying
Buying is not universally open to every foreign national, company or property. TKGM explains that natural-person eligibility depends on nationality and applicable geographic/security and statutory limits; its guidance refers to a 30-hectare individual ceiling and a 10% district ceiling, subject to powers to change limits and specific exclusions. These area limits do not replace an individual eligibility check. Foreign corporate buyers follow a different legal analysis. For a foreign natural-person purchase, TKGM’s 2022 notice requires a bank-issued Döviz Alım Belgesi documenting prescribed foreign-currency conversion, subject to current procedural instructions. Ask your bank and land registry for the applicable currency, conversion route, exchange-rate reference, processing time and bank charges before moving money. Owning an apartment does not by itself award Turkish citizenship, an unrestricted residence permit or a right to work.
Price the entire transaction, not just the asking figure
Use a dated written cost schedule in Turkish lira (TRY), with any negotiated foreign-currency reference recorded separately, and a stated bank exchange-rate and charges assumption. In an ordinary title-deed sale, GİB guidance describes a transfer fee of 2% for the buyer and 2% for the seller, calculated on the legally relevant declared value; the real tax base and current exceptions need verification. If an intermediary is engaged, the Ministry of Trade regulation caps the aggregate brokerage fee at a percentage of the contract sale price excluding VAT, generally shared equally unless otherwise agreed in writing; this is a cap, not an automatic buyer fee, and the current cap should be checked with the Ministry of Trade. Add possible valuation, registry service charges, translations/interpreter, legal, engineering, mortgage, insurance, utility deposits and any project-specific taxes or VAT. Ask whether seller liabilities, furniture and prepaid service charges are included. Never use an understated deed price to simulate savings.
Stress-test returns and cash requirements
Do not compare advertised gross yield with the interest or net return on an alternative asset. Model collectible rent minus vacancy, agent and management fees, repairs, annual municipal/property charges, insurance, landlord taxes where applicable, common-area contributions, financing expense and currency effects. Separately calculate acquisition costs and probable sale friction; short-stay income should be zero in the base case unless legal permission and operating assumptions are evidenced. A flat that appears cheaper per square metre may be materially dearer after structural works or a very high aidat. Ask for comparable completed transactions and actual signed leases from the same micro-market and period rather than mixing portal asking prices, different floor areas and currencies. This guide provides no independently comparable 2026 Istanbul sale dataset, no live listings and no guaranteed rent or appreciation forecast.
Before a deposit: request a documentary pack
Demand seller identity and authority; recent land-registry extract showing parcel, independent section, owners and encumbrances; approved unit plan and construction/occupancy documents; management plan, meeting minutes and accounts; itemized fee/arrears statement; building inspection documents; list of included fixtures, parking and storage; written rental/occupancy approvals when essential; and proposed sale, reservation or development contract. Arrange separate representation or at least independent Turkish-law review, plus qualified engineering advice, rather than relying only on the seller’s adviser. For an unfinished unit, examine completion milestones, developer authority, land rights, delivery obligations, payment protection and contract-specific exit remedies. If source records are withheld, treat the omission as a reason to pause or reject—not as a reason to pay faster.
Keep reservation, verification and transfer separate
A remote viewing and online land-registry application are not the same as a completed conveyance. First, screen the asset and request scans without accepting claims as verified. Second, commission independent title, permits, building and financial reviews; make any reservation expressly conditional, with a clearly documented refund trigger and payee, before risking a deposit. Third, agree the exact buyer, seller, registered unit, consideration, deadlines, currency and payment mechanism in writing, and verify identity and any power of attorney with the responsible office. Fourth, have the Turkish land-registry transfer and payment sequencing confirmed, including any current secure-payment procedure; do not send the full price to an unverified private account on the assumption title will follow. Ownership is generally completed by the required registration, not by receiving keys or a broker’s invoice.
The Ministry of Trade has postponed the mandatory start of the Safe Payment System several times. A postponement announcement does not establish that the necessary amendment is effective or the system available at a particular bank: confirm the current start date, the applicable rule and actual settlement procedure with the land registry and bank before paying.
Three-stage buyer workflow
- Screen: define use, budget and unit requirements, tour actual routes, obtain title and plan copies.
- Verify: hire independent legal and engineering reviewers, inspect management finances, licences, costs and buyer eligibility.
- Commit and register: sign only on documented conditions; coordinate compliant currency, safe funds transfer, official registration and handover.
A workable proceed, renegotiate or stop test
Proceed to formal contracts only if the registered interest and intended use match your needs, foreign eligibility is confirmed if applicable, building condition is acceptably evidenced, future shared costs are understood and settlement steps are controlled. Renegotiate price, timetable or conditions where documents reveal a quantified repair contribution, a remediable title irregularity or an excluded amenity; make the cure a written precondition, not a promise after transfer. Stop if the seller cannot demonstrate authority, the registered unit is different, serious structural warnings go unanswered, material restrictions prevent the intended use, or funds must be transferred without an acceptable ownership/payment safeguard. No local approval, legal clearance or financial forecast is given here: each actual address and buyer requires updated professional verification.
